According to him, he worked as a leading specialist in one of the organizations in the Shovot district (the previous place of work was not disclosed at the request of the applicant), and from April 14, 2022, the employer demanded that he submit a letter of resignation and put pressure on him.
When this situation was taken under the control of the Ombudsman and studied on the spot, the circumstances set out in the appeal were partially confirmed.
That is, the employer made a submission to the trade union, in which asked for consent to terminate the employment contract concluded with S.R. on the basis of paragraph 3 of part 2 of article 100 of the Labor Code of the Republic of Uzbekistan for gross violation of the internal labor regulations.
Despite the rejection of this submission, on July 15, 2022, the employer illegally fired S.R. from his position.
The Ombudsman made a submission to the relevant ministry on this appeal, in which she gave a legal assessment of the actions related to the unlawful dismissal of the applicant S.R. from his position and asked to take appropriate measures against the official who violated the law.
Based on the submission of the Ombudsman, the order to terminate the employment contract with citizen S.R. was canceled and the employee was reinstated to his previous position.
According to Article 181 of the Labor Code of the Republic of Uzbekistan, a disciplinary sanction "Reprimand" was applied to the employer.
